Terms of Service
Welcome to 5C Exchange. By creating an account or using the Service, you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use 5C Exchange.
1. Eligibility
5C Exchange is available exclusively to current students, faculty, and staff of the Claremont Colleges consortium (CMC, Harvey Mudd, Pomona, Scripps, Pitzer, CGU, KGI, and ArtCenter). You must have a valid institutional email address from one of these institutions to create an account. You must be at least 18 years old to use the Service.
2. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You must not share your account or allow others to use it.
- You must provide accurate information when creating your account and keep it up to date.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@5cexchange.com if you suspect unauthorized access to your account.
3. Listings and Transactions
5C Exchange provides a platform for users to list and discover items. We are not a party to any transaction between users. You agree that:
- All listings must be accurate and not misleading. Photos must represent the actual item being sold.
- You may only list items you own and have the right to sell or give away.
- Transactions are made directly between buyers and sellers. 5C Exchange is not responsible for the quality, safety, legality, or delivery of items.
- You are responsible for honoring commitments made to other users.
- Prices and terms are negotiated directly between parties.
4. Prohibited Content and Conduct
You may not use 5C Exchange to list, sell, or promote:
- Illegal items or substances of any kind
- Weapons, firearms, or ammunition
- Counterfeit, stolen, or unauthorized goods
- Alcohol, tobacco, or controlled substances
- Adult content or services of any kind
- Items that infringe on intellectual property rights
- Misleading or fraudulent listings
You may not use 5C Exchange to:
- Harass, threaten, or abuse other users
- Spam or send unsolicited messages
- Circumvent our verification system or share access with non-eligible users
- Scrape, copy, or systematically download content
- Attempt to gain unauthorized access to our systems
5. Community Standards
5C Exchange is a community built on trust. We expect all users to treat one another with respect. Discriminatory, hateful, or abusive behavior will result in immediate account suspension or termination.
6. Eco Impact and Badges
The eco impact scores, CO₂ estimates, and sustainability badges displayed in the app are calculated using EPA WARM methodology and are provided for informational and motivational purposes only. They are estimates and should not be relied upon for scientific or regulatory purposes.
7. Intellectual Property
By posting content on 5C Exchange (listings, photos, messages), you grant us a non-exclusive, royalty-free license to display and distribute that content within the Service for the purpose of operating the platform. You retain ownership of your content. You represent that you have the right to post any content you submit.
The 5C Exchange name, logo, and app design are our intellectual property and may not be used without permission.
8. Account Suspension and Termination
We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion, with or without notice. You may also delete your account at any time through the app's Settings. Upon termination, your listings and profile will be removed from public view.
9. Disclaimers
5C Exchange is provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy of listings, the conduct of users, or the outcome of any transaction. Use the Service at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law, 5C Exchange and its creators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to losses from transactions with other users.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of 5C Exchange after changes constitutes acceptance of the updated Terms.
