Your use of 5C Exchange is also governed by our End User License Agreement (EULA), which sets out our zero-tolerance policy on objectionable content, our content filtering, reporting, and blocking tools, and our commitment to act on reports within 24 hours.
5C Exchange is a venue that connects verified Claremont Colleges students who want to buy, sell, or give away items. We don't own the items, set the prices, or take part in the actual sale; that's between you and the other student. Treat people fairly, follow the rules below and our Safety Guidelines, and you're welcome here.
These Terms of Service ("Terms") are an agreement between you and 5C Exchange ("we," "us"). By creating an account or using the app or website, you agree to them. If you don't agree, please don't use the service.
1. Who can use 5C Exchange
You may use 5C Exchange only if you are a currently enrolled student at one of the Claremont Colleges, are at least 18 years old, and can verify a valid Claremont Colleges email address. Accounts are personal; don't share yours or create one on someone else's behalf. You are responsible for activity that happens under your account.
2. Our role: a venue, not a party to your sale
5C Exchange provides a place for students to list items and connect with each other. We are not the buyer or the seller in any transaction. We do not own, inspect, store, deliver, or guarantee any item, and we are not responsible for the quality, safety, legality, or accuracy of listings or for whether a buyer or seller actually follows through. Any agreement to exchange an item is solely between the students involved.
3. Payments
5C Exchange does not currently process payments or hold funds. Buyers and sellers arrange payment directly between themselves, in person. We charge no fees and take no commission. If we introduce in-app payments in the future, we will publish additional terms before you use them.
4. Your responsibilities
- List items honestly, with accurate descriptions, real photos, and fair prices.
- Only list items you own and are legally allowed to sell or give away.
- Do not list anything prohibited under our Community & Safety Guidelines, including weapons, alcohol, drugs, vapes, controlled substances, recalled or counterfeit goods, or materials that violate your college's academic honor code.
- Communicate respectfully. Harassment, hate speech, discrimination, threats, and spam are not allowed.
- Meet and exchange safely, as described in our Safety Guidelines.
- Don't misuse the service: no scraping, no attempts to break security, no impersonation, no automated abuse.
5. Your content
You keep ownership of the listings, photos, and messages you post. By posting them, you give us a limited, non-exclusive license to display and distribute that content within the app for the purpose of operating the service. You're responsible for the content you post and confirm you have the right to share it.
6. Moderation, suspension, and termination
To keep the community safe, we may review reported content, remove listings, and warn, suspend, or permanently ban accounts that break these Terms or our Safety Guidelines. You can stop using 5C Exchange and delete your account at any time.
7. Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or that listings or other users are accurate, reliable, or safe. You use 5C Exchange, and exchange items with other students, at your own risk.
8. Limitation of liability
To the fullest extent permitted by law, 5C Exchange and its operators will not be liable for any indirect, incidental, or consequential damages, or for any loss arising from a transaction between users, a meeting between users, or your use of the service. Our total liability for any claim is limited to the amount you paid us to use the service, which, at present, is zero.
9. Indemnification
You agree to hold 5C Exchange harmless from claims arising out of your listings, your conduct, your transactions with other users, or your violation of these Terms.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Disputes will be handled in the state or federal courts located in California.
11. Changes to these Terms
We may update these Terms as the service grows. When changes are material, we'll update the date above and notify you in the app where appropriate. Continuing to use 5C Exchange after an update means you accept the revised Terms.
